By accessing or using the Website or the App you confirm that you have read, understood, and accepted these Terms. If you do not agree, please discontinue use.

2. Service Description

The Website presents information about Buinsoft's IT consulting, software development, AI, and database services. The App is a companion that mirrors the content of the Website for iOS devices. Use of either is free of charge.

3. App License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, solely for personal, non-commercial informational purposes. You may not reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law.

4. Intellectual Property

All content on the Website and in the App — including text, graphics, logos, the "Buinsoft" name and marks, software, and design — is the property of Buinsoft or its licensors and is protected by copyright, trademark, and other applicable laws. No content may be copied, modified, distributed, or used for commercial purposes without prior written permission.

5. User Conduct

You agree not to use the Website or the App to:

• Infringe any law or third-party right;
• Submit false or misleading information through any form;
• Attempt to gain unauthorized access to systems, accounts, or data;
• Distribute malicious code, spam, or attempt to disrupt operations;
• Scrape, harvest, or use automated means to extract content without permission.

6. Contact Form & Submissions

Information you submit via the contact form is governed by our Privacy Policy. You confirm that the information you provide is accurate and that you have the right to share it. We may use feedback or general suggestions without obligation to you.

7. Third-Party Services

The Website may load third-party services (e.g. Google Tag Manager) only after your consent via the cookie banner. We are not responsible for the practices, content, or availability of any third-party site or service.

To the fullest extent permitted by law, Buinsoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising from your use of the Website or the App, even if we have been advised of the possibility of such damages. Our total aggregate liability for any direct damages shall not exceed EUR 100.

You agree to indemnify and hold harmless Buinsoft, its officers, employees, and contractors from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Website or the App at any time, with or without notice, for any reason including breach of these Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws principles, subject to the mandatory consumer-protection provisions of the user's country of residence within the EU. The courts of Prague, Czech Republic shall have exclusive jurisdiction over any dispute, except where mandatory law provides otherwise.

13. Apple-Specific Terms (App)

These Terms are concluded between you and Buinsoft only, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any); Apple has no other warranty obligation whatsoever with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14. Changes

We may revise these Terms from time to time. The current version is always at https://www.buinsoft.com/terms. Continued use after changes constitutes acceptance.
